Prompt Pay Legislation (HB 566) Passes PA House Commerce Committee by Unanimous Consent

On Tuesday, June 6, 2017, the Pennsylvania House Commerce Committee passed HB 566 by unanimous consent.  This piece of legislation amends the Contractor and Subcontractor Payment Act (Act 7 of 1994) to allow for suspension of work if payment is not received by a contractor in accordance with the terms of their construction contract.

M&SCA of Eastern PA has been working in partnership with NECA’s Penn-Del-Jersey and IFCA to move this legislation in order to give subcontractors the ability to collect payment in accordance with their contracts and reduce reliance on the Mechanic’s Lien Law.

Passing this legislation has been a lengthy journey, spanning over several years, and finally fairness has prevailed.  We hope both chambers of the legislature support this important bill and send it to Governor Wolf’s desk for his signature.  We would like to thank the co-sponsors of this bill, Representative Jamie Santora and Representative Michael Driscoll, for their tireless efforts on this important issue.  


“We should not expect contractors to finish their jobs if they aren’t being compensated for their time and materials,” Santora said. “This bill would offer protection from incurring additional losses if a customer is not paying fairly and promptly.”


 “This bill levels the playing field for all subcontractors. I’m delighted with its bipartisan support,” Driscoll said.
