M&SCA Member Jim Gaffney of Goshen Mechanical Participates in Separations Act Debate

On Thursday, July 13, M&SCA of Eastern PA Contractor Member Jim Gaffney of Goshen Mechanical, along with John Wanner of Wanner & Associates participated in a debate regarding the Pennsylvania Separations Act held by the Pennsylvania Chapter of the American Institute of Architects.  The moderated debate featured key players on both sides of the issue of whether to maintain the current law. 

 

Both Jim and John articulated clearly the importance of the Separations Act to those in attendance, maintaining one key point: the multiple prime delivery system has created quality, transparency, and value for state agencies in the bidding process through competition and an open and fair bidding system.

 

For nearly 100 years, Pennsylvania taxpayers, school districts, and contractors have greatly benefited from a fair and open HVAC, Electrical, & Plumbing bidding process due to the Separations Act.  Additionally, strong competition from qualified, bondable HVAC, Electrical, & Plumbing Contractors on public construction projects has consistently kept prices low for Pennsylvania and its taxpayers.  Without the Separations Act, out of state contractors would become more apparent and allow them a virtual monopoly on Pennsylvania’s public construction projects.  Ultimately, limited competition on public projects increases the potential for bid collusion and price fixing.
